Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: The hazard of falling off and being run over by a Construction King Case 580D, Serial Number 9055604, back hoe/front-end loader while riding on the step of the machine. One feasible and acceptable abatement method to correct this hazard is to prohibit any employee from standing or sitting on equipment such as the Case 580D backhoe, other than in approved passenger seats, while the equipment is in motion. The National Safety Council Publication; Data Sheet I-589, copyright 1977, "Front-End Loaders" prohibits passengers from riding on equipment.
