Section 5(a)(1) of the Occupational Safety and Health Act of
1970: The employer did not furnish employment and a place of
employment which were free from recognized hazards that were
causing or likely to cause death or serious physical harm to
employees in that employees were exposed to fire and inhalation
hazards from a release of hydrogen sulfide from a 6300-gallon
flammable liquids trailer which did not have its dome lid because
it had been removed by company maintenance. This information had
not been conveyed to the operators by such means as marking the
trailer out of service and an appropriate lid had not been put in
place of the original dome lid.
Among other methods, feasible and acceptable abatement
methods to correct the hazards would be to:
a.Set up a tagout system for the residue trailers under
repair to inform both truck operators and unit
operators of the repairs.
b.Assure an appropriate lid is on the residue trailer at
all times, even during repair work on the dome lid.
