Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to a serious fall hazard while being transported on elevated safety platforms attached to the forks of forklift trucks. Warehouse: Employees were transported aloft from rack to rack in elevated safety platforms attached to forklift trucks, by operators using forktrucks not equipped with controls which were elevatable with the lifting carriage. In accordance with ANSI B-56.1 dated 1988, section 5.2.24 (h): move the truck only for minor adjustments in positioning when personnel are on the work platform, and never at more than creep speed. One method to correct the condition is to have the employee disembark the safety platform each time they are lowered and walk to the next rack prior to being elevated.

Warehouse: The employees were not wearing the seatbelts while operating the Nissan forklift trucks.t
