Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees, in that, employees
were exposed to potentially fatal crushing injuries while moving a 4,000
pound I beam that was
suspended between two forklift trucks.
Establishment:
On October 27, 1999, the employees operating the two Kamatzu forklift
trucks were
exposed to serious injuries while attempting to move a 40 foot long, two
ton I beam.
One method, among other methods, to correct the condition would have been
to use a
vehicle with the proper capacity to move the I beam from one side of the
yard to the
other side.
