Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by material handling equipment with inoperative or defective safety devices. Location: Yard 1) Caterpillar 950, Serial Number 81J1147 had the following deficiencies: a)Inoperative back-up alarm. b)Inoperative windshield wiper c)Three inoperative headlights d)Inoperative emergency brake e)Mirrors were missing 2) Caterpillar 950, Serial Number 31K1547 had the following deficiencies: a)Inoperative back-up alarm b)Cracked windshield, cracked rear window, cracked left hand drivers door window, and cracked lower right front window c)Left front tire was missing two nuts and a lug d)Lower headlight missing e)Rear back-up light broken f)Mirrors were missing 3) Caterpillar 215 Excavator had the following deficiencies: Back-up alarm was not installed Methods, among other methods, to correct the conditions are as follows: 1.Install or repair safety equipment. 2.Establish a preventative maintenance program to repair defective equipment prior to use within the yard.n
