Section 5(a)(1) of the Occupational Safety and Health Act of 1970: %% The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a potential collapse of the walkway located above the pit access way: Pit: The upper walkway was in potential danger of collapsing as a result of allowing the rear of buses to rest on the concrete surface. The walkway was neither designed nor rated to accept the loads imposed by the weight of the buses. Also the concrete appears to impregnated with engine oil further degrading the strength of the concrete walkway. One method, among other methods to correct the conditions, would be to replace the existing concrete walkway with a metal work platform. The new platform should be placed at a lower than the present structure thereby preventing buses from making contact with the structure while they are parked above the pits.
