Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: Legacy Coit Retail Center, Phase II, 9460 Coit Road, Plano, TX 75075: On or about Friday, September 14, 2001, at least two employees, who were accessing the roof of the Legacy Coit Retail Center via the 32-foot, type I, aluminum extension ladder were exposed to hazard of contracting a possible bloodborne pathogen. After an employee cut his hand and spilled blood on the left side-rail of the ladder and the parapet wall, the employer did not assure that the equipment and work surface was cleaned and decontaminated.
