Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees; in that, employees were exposed to the inadvertent actuation of the shearing operation: a.)Machine Shop, Wysong & Miles Company Metal Cutting Shear, Model 572-A. The foot pedal was not guarded, which could inadvertently actuate the shearing operation. ABATEMENT NOTE: One feasible and acceptable abatement method, among others, to correct this hazard is to guard the foot pedal as referenced in ANSI B11.4-1983, American National Standard for Machine Tools - Shears - Safety Requirements for Construction, Care and Use.
