Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees; in that, employees were exposed to the inadvertent actuation of the shearing operation. a.)Sheetmetal shop; the treadle that operated the Cincinnati Shear, #22559, was not completely guarded. Abatement Note: One feasible and acceptable abatement method, among others, to correct this hazard is to guard the foot treadle as referenced in ANSI B11.1-1983, American National Standards for Machine Tools-Shears-Safety Requirements for Construction, Care, and Use.
