Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Section 5(a)(1) of the Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that on or about 3/1/96 at the Carraway Cancer Research Center construction jobsite, employees were exposed to: The hazard of falling material when employees used entrances and exits to the building located under the material loading platform (pokeout) above which tower crane suspended loads were lifted and lowered to and from the pokeout. Among feasible and acceptable methods to correct this hazard would be to relocate the material loading platform (pokeout) or to provide barriers and/or post an employee at the main building entrance and exits to alert employees to use an alternative route when loads are being suspended and lowered from overhead.
