Section 5(a)(1) of the Occupational Safety and Health Act of 1970:
The employer did not furnish employment and a place of employment
which were free from recognized hazards that were causing or likely
to cause death or serious physical harm to employees in that
employees were exposed to crushing hazards:
(a)Garage , Alignment Bay #3, 201 East Crawford Avenue
Connellsville, Pa 15425; (1)  There were no physical
barriers in place at the front end of the alignment rack
to prevent a vehicle from rolling forward off of the
rack; (2)  There was no pedal depressor provided that
would lock the vehicle's brakes;  (3)  There was no
training program provided outlining the safe operating
procedures for securing vehicles on the racks while
performing front end alignments and other diagnostics.
On or about March 1, 1997, an employee was fatally
injured while attempting to check the front end alignment
on a Ford Explorer. The Explorer was placed onto
alignment pit #3 turning plate in the neutral gear
position, with the emergency brake not engaged, and the
rear wheels were not chocked to eliminate the vehicle
from drifting forward. This resulted in an employee being
fatally injured when the truck rolled forward, going off
the rack, pinning the employee against a block wall and
the left front bumper of the vehicle.
"Among other methods, one feasible and acceptable
abatement method to correct this hazard is to require the
utilization of front U shape attachments in order to
eliminate a vehicle from rolling off the front end
alignment pit rack, utilize pedal depressors, and
institute a training program outline safe operating
procedures  in accordance with Bear Manufacturing Company
training manual entitled Principles Of Wheel Alignment
Service written by E.Miles Bacon, M.A. Director of
Training, Bear Manufacturing Company.
