Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to confined space hazards such as toxic, explosive or
asphyxiating atmospheres:
(a) On or about August 9th, 1995, employees working at Pembroke Shores
Development in
Pembroke Pines, Florida entered a manhole at a sewer lift station and
conducted a paint
inspection.  A gasoline-powered pump was lowered into the space while
employees drained
water from the bottom, approximately eighteen feet.  Employees entered the
confined space
without a hazard assessment being conducted prior to entry to identify
existing or potential
hazards in the space such as:
1.  Oxygen deficiency within the confined space
2.  Evaluation of flammability/explosive atmosphere
3.  Toxic atmospheres created due to the nature of the work being performed
Among other methods, one feasible and acceptable abatement would be to
follow the procedures
for the confined space entry described in ANSI Z117.1-1989 and NIOSH
Publication A Guide
to Safety in...CONFINED SPACES.
