Section 5(a)(1) of the Occupational Safety and Health Act of 1970:
The employer did not furnish employment and a place of employment
which were free from recognized hazards that were causing or likely
to cause death or serious physical harm to employees in that an
employee was exposed to a fall hazard estimated to be approximately
14 to 15 feet while working in the elevated bucket of the
excavator:
a.3734 Teays Valley Road - On or about August 11, 2003 an
employee was re-attaching a sagging telephone cable to a
supporting cable.  Employee was elevated in the bucket of
the Cat 320 CL excavator to reach the telephone cable.
The employee did not have fall protection and was exposed
to a fall estimated to be approximately 14 to 15 feet.
Among other feasible and acceptable methods to correct this hazard
are to:
a.Prohibit employees from using the elevated bucket of the
excavator as a work station.  Instruction in the
Operation and Maintenance Manual states " make sure that
no personnel will be endangered before you move the
machine.  Do not allow riders on the machine unless the
machine has an additional seat with a seat belt".
b.Utilize acceptable devices such as ladders, scaffolding
or aerial lifts for employees working elevations.
c.Follow instructions in the Safety Manual for Users,
Operators, and Maintenance Personnel for Hydraulic
Excavators published by the Construction Industry
Manufacturer's Association which states"Never allow any
one to the ride the attachment or load. This is an
extremely dangerous practice."
