Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing injuries from the failing 100 foot lattice boom of the Bucyrus Erie 70 Ton truck crane when this crane, an excavator, a truck (road tractor) and a chain were used to move a steel launch beam which was approximately 95 feet long by 8 feet wide and weighed approximately 52,000 pounds due to the employer did not designate a competent person to be responsible for the operation and who analyzed the operation and performed an evaluation to make a determination to ensure the load on the truck, crane, excavator and the chain were with in their rated capacities during all phases of the operation on or about 4-1-03. "AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD WOULD BE NOT TO USE THE CRANE, THE TRUCK, THE EXCAVATOR AND A CHAIN TO MOVE THE LAUNCH BEAM BUT INSTEAD TO RE-POSITION THE TWO BUCYRUS ERIE CRANES SO THEY COULD DUALLY LIFT THE LAUNCH BEAM ON TO THE ROAD DETOUR WHERE THE TRUCK COULD BACK UP TO IT, HOOK ON TO IT AND PULL IT OFF THE PROJECT AND TO DESIGNATE A PERSON RESPONSIBLE FOR THE OPERATION WHO WOULD ANALYZE THE OPERATION,INSTRUCT ALL PERSONNEL IN THE PROPER POSITIONING, RIGGING OF THE LOAD AND THE MOVEMENT TO BE MADE."NT
