Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were likely to
cause death or serious physical harm to employees exposed to crushing
injuries as a result of the
hazards associated with the use of the John Deere 850 J dozer during a
winching operation as an
inadequate anchorage for the John Deere 200 CLC excavator.  The excavator
pulled the dozer down
the hill and in the attempt to make it back up to the top of the slope the
winch cable pulled tight again,
therefore causing the dozer to flip back and roll down  the hill on to the
excavator and then to the
bottom of the hill as determined on 4-24-07.
In the Alternative:
29 CFR 1926.602(a)(3)(i) The employer allowed construction equipment up on
access roadways or
grades that were not constructed or maintained to accommodate safely the
movement
of the equipment
involved:
a.Arvilla Pipeline Construction Inc. Working at Rich Creek - The John
Deere 200 CLC
excavator equipped with a hammer was working in conjunction with the John
Deere 850 J
dozer on a grade / hill side to break up the rock in order to bury the gas
line in an excavation.
The grade in which the equipment was working did not accommodate safely
the movement of
the equipment due to the John Deere 200 CLC excavator pulled the John
Deere 850 J dozer
down the grade and it eventually rolled on to the excavator and then on to
the bottom of the
slope as determined on 4-24-07.
One feasible and acceptable abatement method to correct this hazard is for
the employer to develop
and implement a safe procedure which would include steps, such as but not
limited to, ensuring that
the machine that was assisting another machine while working on a slope
was
of proper size, strength
and was positioned to provide maximum stability for an anchorage. Also
machine operators must be
qualified and during such operations must maintain communication at all
times while working on
slopes.
