Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to possible accidents from improperly maintained bulldozers and improper operator training for bulldozers: 1.Fuel Building - Employees are not properly trained in bulldozer operations. 2.Fuel Building - Cat Bulldozer D6H #1 seat belt was inoperable, the right side lights did not work and the window of the left door was shattered. 3.Fuel Building - Cat Bulldozer D6H #2 the right side lights did not work. One feasible means of abatement would be to train employees in bulldozer operations and properly maintain bulldozers.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to second hand smoke from cigarettes: Throughout the Facility - Smokers are allowed to smoke throughout the facility even though the company does have a No Smoking Policy, which limits employee smoking to two outside areas. One feasible means of abatement is to enforce the company's No Smoking Policy.
