Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing injuries in the event of forklift accidents: In the following instances employees were not wearing seatbelts when operating forklifts: a)Wine Warehouse - An operator of a Toyota Forklift #71063 was not wearing a seatbelt during forklift operations. b)Beer Warehouse - An operator of a DaeWoo Forklift #CV-00-570 was not wearing a seatbelt during forklift operations. One feasible means of abatement is to enforce the employer's policy requiring seatbelts be worn at all times.lts
