Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to struck-by hazards when a crane used to off load a truck
containing stone
became overloaded and nearly toppled:
18th & Constitution Avenue, NW - On or about 1/27/95 a National Crane
500-H Series
mounted on an L-9000 Ford straight body truck was severely overloaded
while trying to
pick 4 slate curb sections off the tail end of a flat bed tractor trailer.
Because of the
distance and angle of the boom and the weight of the load, the right
outrigger and rear
tandems were observed to be several feet off the ground, thus exposing the
employees
to the hazard of the crane tipping over while under load.
One useful and feasible means of abatement would be to follow the
guidelines
set forth
in the American National Standards Institute publication entitled American
National
Standard for Mobile Hydraulic Cranes, ANSI B30.15 - 1973.  Section 15
3.2.1(a)
states that "no crane shall be loaded beyond the rated load" and "the
weight of all loads
shall be determined before lifting".
