Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: At the facility, in the warehouse, the operator of the Nissan 30 forklift was driving with the seat unbuckled. This practice exposed him to the hazard of being ejected and crushed by the machine in a roll-over accident. Among other methods, one feasible and acceptable abatement method to correct this hazard is to require the operators to wear their seat belts at all times when they are sitting in the seat of the powered industrial trucks, regardless of the length of time that they will be in the seat.
