Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: At the RENG Student Center addition located on the ASU campus, where the operator of the Dynalift DP463 rough terrain, high lift fork truck was observed traveling throughout the area with his seat belt unbuckled. This practice exposed the operator to the hazard of being ejected and crushed by the machine in a roll-over accident. Among other methods, one feasible and acceptable abatement method to correct his hazard is to require the operator to wear their belt at all times while he is sitting in the seat of the powered industrial truck, regardless of the length of time that he will be in the seat, as warned by the manufacture of the lift in a warning posted on the frame of the lift.
