were causing or likely to cause death or serious physical harm to

were exposed to the condition(s) listed below:
At the job-site located at 915 East 1st Street, Dumas, TX 79091, for the
period of time up to
and including 11/20/02 where the operator of the JCB 930 rough terrain
fork lift (powered
industrial truck), serial number 660801, was observed traveling throughout
the area with his seat
belt unbuckled.  This practice exposed the operator to the hazard of being
ejected and crushed
by the machine in a roll-over accident.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is
to require the operator to wear his seat belt at all times when sitting in
the
seat of the powered
industrial truck, regardless of the length of time that he will be in the
seat, as warned by the
manufacturer.
