Labor and Employment Article, Section 5-104(a), Annotated Code of
Maryland:  The employer did not furnish
employment and a place of employment which were free from recognized
hazards that were causing or likely to
cause death or serious physical harm to employees:
(a)Date of Violation:04/16/99
Location:Fuel Storage Room next to Loading Dock
Condition:Employees who fill a vertical 6000 gallon #2 fuel tank are
exposed to an approximate 17'
- 18' fall hazard while accessing and exiting the top of the tank from a
Werner 24'
fiberglass extension ladder.  The ladder's top rung can not be placed any
higher on the
tank than approximately 1'- 2' below the top of the tank due to the space
limitations of
the room.  Employees have to get on their knees and back up to the edge of
the tank then
place one foot over and down the side of the tank to feel for the top rung
of the ladder
which is approximately 16' above the concrete floor.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is to utilize the 4" quick
connect fill pipe located inside the loading dock at ground level there by
eliminating the need to climb up onto the
tank to fill it.l
