General-duty citation text
T.C.A. 50-3-105(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were likely to cause death or serious physical harm to employees. An example on 8/12/05 was the suspect accuracy of the BW Technologies Gas Alert NH3 portable ammonia monitors used by Maintenance Personnel to define when it was necessary to don self- contained breathing apparatus (SCBA) respirators during an ammonia leak or release situation anywhere in the ammonia refrigeration system in the plant. Calibration for the portable monitoring meter inspected (J 304-A006990, GAXT-A) was "past" (the instrument screen said "Cal Past"). Page 3 of the user's manual said that the instrument was to be calibrated at least every 180 days. The expiration date given on the ammonia gas cylinder used for calibration was 8/9/05, so that the cylinder was past its expiration date on the date of the inspection. The employer recognized the toxicity of the ammonia, as evidenced by its material safety data sheets (MSDS's) on that chemical. He also recognized the need for protection against exposures to the gas, as evidenced by his requirement for SCBA use in areas of ammonia release yielding concentrations over 25 ppm. The above-listed employees were potentially exposed to ammonia, which could be released if equipment leaked. The hazard of inaccurate portable ammonia monitors was reasonably foreseeable. Among other methods, one feasible and acceptable abatement method to correct this hazard is to calibrate the ammonia portable monitors within the frequency stated by the manufacturer, and to only utilize calibration gas that is within its expiration date.
