Section 5(a)(1) The Occupational Safety and Health Act of 1970. The employer did not furnish to each employee employment and a place of employment which were free from recognized hazards that are causing or likely to cause death or physical harm to his employees in that employees were exposed to a fall in excess of 10 feet when they were permitted to climb and descend through the midrail section located on the scaffold, by way of a portable extension ladder. 05/28/98 a. North side of Delmar Water Treatment Plant, Delmar DE A feasible method of abatement to correct this hazard would be the installation of a swing gate, or chains secured across the opening.
