Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falls: The employer fail to provide a place of employment which was free from hazards that were likely to cause death or serious physical harm to employees in that the employees were exposed to falls from heights ranging from six to fifty feet while working on billboards without any form of fall protection. Although a safety belt with lanyard was provided, the lanyard was attached to the ladder in use during the entire process of bill posting. The ladders, manufactured by the Werner Co. were modified with after market additions, (ladder hooks) which they were not designed for.gned
