Section 5(a)(1) of the Occupational Safety and Health Act of 1970:
The employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to:
a) On or about 5-5-94, the employer work schedule did not allow for
proper curing time
of masonry cement mortar which scheduled seven of Bando Construction,
Inc. employees to
enter an 8 ft. deep concrete block residential basement thereby exposing
them to a struck-by
hazard.   Among other methods, a feasible and acceptable abatement method
to correct this
hazard is as follows:
FEASIBLE ABATEMENT:  1.  Use of adequate braces to sustain the stress on
the
masonry
wall due to lateral force exerted by backfill.
2.  Review of work flow schedules to ensure proper curing that will
resist the lateral force
exerted by backfill to maintain a safety factor margin of error due to
backfill.
