Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) In the yard, receiving area, and tree/shrub area, the employer did not require the operators of the 25 Komatsu propane forklift (Model: FG25T-11, S/N: 467917A) to use the equipped seat belt, thus exposing employees to a potential struck-by/caught-in hazard. Among other methods, one feasible and acceptable abatement method to correct this hazard is the following: 1. Require and enforce the use of the seat belt on the forklift.
