Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: In that employees were exposed to the operation of forklifts without using the seat belts supplied by the manufacturer. ASME/ANSI B56.1-1993, Safety Standard for Low Lift and High Lift Trucks, requires manufacturers to provide, and operators to wear seat belts (operator restraint systems). Workers in the Reclaim Area were operating forklifts (i.e. Yale LP type lift truck, serial #N525488) without using the seat belts provided by the manufacturer. Additional abatement information is required for this item.
