Section 5(a)(1) of the Occupational Safety and Health Act of 1970:
The employer did not furnish employment and a place of employment
which were free from recognized hazards that were causing or likely
to cause death or serious physical harm to employees in that:
1) An employee was directing traffic without the aid of
advance warning signs to motorists that a flagman was in the
roadway ahead as prescribed in ANSI D6.1-1971.
2) Employee(s) working on/near the boom truck on this site
were exposed to collision with oncoming traffic in that the
truck was parked encroaching onto the Eastbound Traffic lane
with vehicular traffic travelling at a legal speed of 35 mph,
with no advance warning signs to motorists that work was being
performed on the shoulder/roadway placed in accordance with
ANSI D6.1-1971.
Feasible and acceptable methods to correct these hazards would
be to ensure conformance with the American National Standards
Institute D6.1-1971, Manual of Uniform Traffic Control Devices
for Streets and Highways are met.
