Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: On or about December 11, 1998, an employee was exposed to the hazard of asphyxiation while entering confined spaces (CEV unit) in that acceptable confined space entry procedures, including testing to determine the presence of an oxygen deficient atmosphere, or the presence of flammable or toxic contaminants, was not conducted. Among other methods, feasible and acceptable means for abating this condition include testing the confined space, and implementing and following confined space entry procedures for entering any CEV unit, such as stipulated by 29CFR 1910.146 General Industry Standards for Permit Required Confined Spaces, or ANSI Z117.1 -1989 Safety Requirements for Confined Spaces.
