Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that:
On and before 6/6/97 employee were exposed to the hazards of falling,
swinging into and/or
striking the telecommunications tower when they were hoisted aloft,
individually and in
groups of two employees, to the top of the 300 foot tower by a capstan
hoist mounted to the
front of the Ford Stakebed work truck.  Employees were attached to a
hand-tied loop in the
end of the 1/2 inch polypropylene hoist line which was reeved through a
wheel block at the
top of the tower.
Among other methods, one feasible and useful method to eliminate this
hazard is to:
1.  Implement and enforce a work rule which prohibits the hoisting of
personnel by this
material hoist as required by the hoist manufacturer.
2.  Provide and require the safe use of alternative means to access towers
such as, but not
necessarily limited to fixed ladders with cage protection, offset
landings, or ladder climbing
safety devices.  The tower on this site was equipped with a ladder
climbing safety device.
