Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: In that the employer did not enforce the use of fall protection equipment worn by employees when installing trusses approximately 12 ft. 6 in. above finish floor of the building. Among others some feasible and useful methods to correct this hazardous condition would be to use safety belts and lanyards rigged as a restraining device to prevent fall, safety harness and lanyard, scaffold with guardrailings, and aerial lifts or equivalent fall protection.
