Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to:
The possibility of lacerations, crushing and amputation from the hazards
associated with the
unguarded point of operation on the 100 ton Wysong Press Brake #H.P.B
46-102.  Employees
were not trained to recognize if the point of operation guards were
properly applied and adjusted
to assure safe operating procedures were being followed and employees
inspecting , caring for
and monitoring the presses were not trained and competent to determine if
the safeguards used
to protect the employees from contact with the point of operation were
provided, properly
adjusted and operating correctly.
Among other methods, one feasible and acceptable abatement method to
correct
this hazard, but
not limited to, is to establish formal die setting procedures which
include training in OSHA &
A.N.S.I. requirements and any instructions from the manufacture,
verification by a competent
person that will assure the proper application and adjustment of the
safeguards before the
operators begin operation and training of the operators in all applicable
OSHA and A.N.S.I.
standards along with the manufacturer recommendations in the use of point
of operation
safeguards and providing hand tools and training the employees in the
proper way to remove
stuck or dislocated parts.  The minimum training operators receive shall
include:
1)  A description and identification of the hazards associated with the
operation of power
press brakes
2)  The safeguards used, how they provide protection and the hazard for
which they are
intended
3)  How to use the safeguard and why
4)  How and under what circumstances safeguards can be removed and by whom
5)  What to do if the safeguard is damaged, missing, inoperative or unable
to provide
adequate protection
6)  What type of cycling method shall be used i.e., two hand controls or
foot pedal.  These essential elements are stipulated in A.N.S.I. B11.3 1982

The possibility of crushing, lacerations and amputations from the hazards
associated with a
malfunctioning press brake due to the lack of regularly scheduled
inspections and maintenance
on the Wysong Press brake #HPB 46-102 by a competent person.
Among other methods one feasible and acceptable abatement method to
correct this hazard is,
but not limited to, to train all supervisors and die setters in all
applicable OSHA and A.N.S.I
standards relating to press brakes along with all the manufacturer
suggestion and requirements
with special emphasis placed on the proper application and adjustment of
all safe guards and
cycling methods.  The employer shall set up a system for conducting and
maintaining records
of the daily, weekly, monthly and annual inspections required by A.N.S.I.
B11.3 1982, section
5.1.4.n
