Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to being struck by swinging loads and loads falling off the
hoists due to broken
and/or fallen components of the hoists, hooks and the below the hook
attachments, in that:
(a)Operators turning tanks such as the T-90 tanks, used a 1 ton hoist
without assuring
adequate manuevering space or adequate procedures to avoid being struck by
swinging loads.
Below the hook lifting devices such as but not limited to; the five made
in house by Stock Mfg.
used to lift tanks such as the T-60s, 90s and T-120s on the 5 ton and the
1 ton hoists in the Hi-
Bay had not been load tested nor were they identified with the following
information,
manufacturer's name and address, serial number, and rated load prior to
use.
Among feasible abatement method to correct the hazards, is to ensure
through procedures and
training that the load be raised in such a manner as to minimize swinging,
and operators position
themselves in such a manner as to minimize exposure to being struck by the
load. Further, to
conduct periodic and frequent inspections of all hoist, hooks, and
below-the-hook lifting devices
to ensure that hoists, hooks and below the hook attachments are free from
recognized hazards
as required by ASME B30-20c-1998, and prior to initial use of all new,
altered, modified or
repaired below-the-hook lifting devicing should be tested and inspected
under the direction of
a qualified person and a written report be furnished by such a person as
required by addenda to
ASME B30.20-1993 for Below-the-Hook lifting devices, by ASME B30.10-1993,
hooks, and
as required by ASME B30.16-1993 for Overhead Hoists (Underhung).
