Section 5(a)(1) of the Occupational Safety and Health Act of 1970: the
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that employees were
exposed:
a)On or about September 22, 1998, employees were exposed to the hazard of
physical injury and/or death while traveling in a TUG vehicle on the ramp
area
in that:
The employer did not take adequate measures to prevent occupant injuries,
from
vehicle accidents, impact of occupants against internal vehicle parts and
ejection
from the passenger compartment in that:
(1)Employees were not instructed nor required to wear active
passenger restraint devices (seat belts) while traveling this vehicle;
(2)Employees were not instructed nor required to observe vehicle
passenger capacity limitations in that nine passengers were in an
eight passenger capacity vehicle, (TUG), and one occupant did not
have a vehicle seat available with an active passenger restraint
(seat belt).
(3)An operator of a TUG who was not familiar with the Ramp Area,
Ramp Traffic Flow Pattern, or operation of the vehicle and had not
been certified as an operator for the vehicle or the Ramp Area,
was permitted to operate the TUG on the Ramp during the peak
(Prime Time) operating period.
One feasible method of abatement among others, is to:
(1)Follow the vehicle manufacturer's recommendations regarding the
use of seat belts and occupant loading;
(2)Ensure that only vehicle operators who are familiar with the
operational rules or procedures regarding the Ramp Area or Ramp
Traffic Flow Pattern, are permitted to operate the TUG on the
Ramp during peak (Prime Time) operating periods.
(3)Ensure that vehicle operators are proficient in the operation of the
vehicle which can be demonstrated through training and
certification on that vehicle, before being permitted to operate the
vehicle on the Ramp Area during peak (Prime Time) operating
periods.
