Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) On or about March 25, 1998 employees were riding in and installing siding while being elevated in the bucket of a John Deer 610 c back hoe loader were exposed to crushing and striking hazards due to being caught between the back hoe loader bucket and structural walls, pavement, or other portions of the back hoe. Among other methods of feasible and acceptable abatement to correct these hazards are but not limited to the use of appropriately guarded scaffolds, work platforms, aerial lifts or other means which would provide both safe access and fall protection.
