Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the potential of being struck by a motor vehicle while inside or immediately adjacent to shelters at the Paint House Gate near Dock 41 of the General Motors Corporation North American Truck Platform and at the Gate #1 entrance to the General Motors Corporation Powertrain plant: Among other methods, feasible abatement measures include: a, Installation of a barricade between the guard shelterhouse and vehicular traffic; b, Demarcation of the guard shelterhouses with high visibility paint, cones, or stanchions; c. Relocation of the shelterhouse so that it is not in the line of traffic line.
