Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employmnent and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to being struck by a falling tote pan at the Cells in the
shop where employees
stood under suspended pans and shook them:
Among other means, feasible methods of abating the condition include:
a. Prohibiting employee use of that method for clearing jams in the tote
pans and
alternatively requiring them to lower the tote pans and manually clearing
them;
b. Use of a improved design tote pan which contained no abrupt changes in
the pan width
where parts could jam.
c. Assuring that employees use a proper lifting attachment and do not wrap
the hoist
chain around the load.
The gravity based penalty for the above alleged violation was $2,500.  The
proposed
penalty reflects consideration, where appropriate, for the employer's good
faith, size of
business and history of previous violations.
