Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to:
(a)  On or about April 22, 1998, employees were exposed to potential
engulfment hazards while
entering Equalization (EQ) Basins such as Basin #1, which contained water.
Among other methods, feasible and acceptable means for abating this
condition include the
implementation of a confined space entry program, including an assessment
to identify confined
spaces and permit required confined spaces, development and implementation
of safe entry
procedures for each space, and procedures to require and enforce the use
of appropriate
protective equipment and/or rescue equipment to prevent engulfment of
employee(s).
