Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employees and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the hazards being struck by tow hooks:
(a)On or about April 30, 1998, employees were exposed to the hazard of
being
struck by tow hook(s) due to the practice of using the 15,000 pound
capacity tow hooks to pull
out stuck mixer trucks that weigh 31,000 pounds unloaded.
Among other methods one feasible and acceptable abatement method to
correct this
hazard is:
(1)  Using tow hook(s) to only pull loads not in excess of their rated
capacity.
(2)Assuring that when tow hooks are used, making sure that all personnel
are clear
of operation in the event of a failure that may occur.
