Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: On or about November 4, 1997, employee(s) were exposed to the hazard of being struck by traffic while working in the roadway of SR 734 in Jeffersonville, Ohio. Among other methods, one feasible and acceptable abatement method to correct this hazard is to provide flaggers when operations are such that signs, signals, and barricades do not provide the necessary protection on or adjacent to a highway or street.
