Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to moving public traffic vehicles:
(a)On or about September 28, 1998 employees were exposed to the hazards of
being
struck by vehicular traffic due to there being established policies or
procedures in place
regarding the safe movement of workers across active roadways. Among other
methods one
feasible and acceptable abatement to correct the hazard is:
1.Follow the Ohio Department of Transportation manual of uniform Traffic
control and or:
2.Establish written procedures and policies for the safe movement of
workers across active
roadways.
