Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees exposed to fall hazards while working at elevated heights during tree removal operations: a) On 11-11-04, at 4843 Aspen Lane in Commonwealth, Wi., an employee was fatally injured as a result of a fall from a tree. The employee, while cutting the top section of the tree with a chain saw, was exposed to a fall hazard of 25 to 30 feet above the ground and was not using fall protection. A feasible abatement method is to follow the American National Standards Institute standard Z133.1-2000, for Arboricultural Operations - Pruning, Repairing, Maintaining, and Removing Trees, and Cutting Brush - Safety Requirements as applicable. No Abatement Certification or Abatement Documentation required.tion
