Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employmnent and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed finger amputations from point of operation hazards on press
brakes:
a)  The #6 and #7 Cincinnati press brakes were not equipped with
components, modules,
devices, or systems that had safety-related functions that would prevent
an unintended cycle,
where employees were required to place their hand(s) in the dye. The
Cincinnati press brakes'
presence sensing devices (light curtains) did not conform to the American
National Standards
Institute (ANSI) industry standard B11.3-2002 edition of Safety
Requirements for Power Press
Brakes, section 8.3, a) to prevent initiation of hazardous machine motion
(or situation) until the
failure is corrected or until the control system is manually reset; or b)
to initiate an immediate
stop command and prevent re-initiation of hazardous machine motion (or
situation) until the
failure is corrected or until the control system is manually reset; or c)
to prevent re-initiation of
hazardous machine motion (or situation) at the next normal stop command
until the failure is
corrected of until the control system is manually reset.
Among other methods, a feasible and acceptable method of abatement to
correct this hazard is
to equip the press brakes with control reliable components and/or
eliminate the need for hands
in the point of operation.
