Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fractures and crushing injuries: a) Service Shop, Bay #1 - The Gilbarco (Model 12C) automotive lift was observed in use with 2 employees standing underneath a vehicle on the lift and adequate safety controls were not implemented. A lift automatic locking device was not installed to function as an independent mechanical lock, nor were alternative safeguards (e.g. properly rated and placed jack stands) in place to ensure safe operation of this equipment. b) Service Shop, Bay #2 - The automatic locking device on the Globe (Model FSR OT FBH-28) automotive lift would not have independently held an elevated vehicle (in the lift's maximum vertical position) as the lock was defective. Alternative safeguards (e.g. - properly rated and placed jack stands) were not used to ensure the safe operation of this equipment. Additionally, the spring for the hydraulic oil valve, that provided an automatic safety closure feature, had to be replaced on this lift. c) Service Shop, Bay #3 - The Gilbarco (Model 12C) automotive lift was not installed with an automatic locking device (to function as an independent mechanical lock), nor were alternative safeguards (e.g. - properly rated and placed jack stands) used to ensure safe operation of this equipment. d) Service Shop Bay #4 - The Globe (Model FSR-28) automotive lift was observed in use with an employee standing underneath a vehicle on the lift and adequate safety controls were not implemented. The lift's automatic locking device would not have independently held an elevated vehicle (in the maximum vertical position) as the lock was tested and found to be defective. Alternative safeguards (e.g. - properly rated and placed jack stands) were not used to ensure the safe operation of this equipment. e) Service Shop, Bay #5 - The Gilbarco (Model 12C) automotive lift was not installed with an automatic locking device (to function as an independent mechanical lock), nor were alternative safeguards (e.g. - properly rated and placed jack stands) used to assure safe operation of this equipment. Additionally, the spring for the hydraulic oil valve, that provided an automatic safety closure feature, had to be replaced on this lift. f) Service Shop, Bay #6 - The Gilbarco (Model 12C) automotive lift was not installed with an automatic locking device to function as an independent mechanical lock), nor were alternative safeguards (e.g. - properly rated and placed jack stands) used to ensure the safe operations of this equipment. g) Service Shop, Bay #7 - The Gilbarco (Model A12M3) suspension type automotive lift was observed in use with an employee standing underneath a van on the lift and adequate safety controls were not implemented. A lift automatic locking device was not installed to function as an independent mechanical lock, nor were alternative safeguards (e.g. -properly rated and placed jack stands) in place to ensure safe operation of this equipment. Additionally, this hydraulic lift did not have a low-oil safety control device (e.g. - safety float control) to restrict the introduction of air into the hydraulic system which could of caused erratic operation of the lift. The employer did not implement an inspection or preventive maintenance program for this lift, including its hydraulic oil subsystem, to ensure the safe operation of the lift. h) Service Shop, Bay #8 - The Gilbarco (Model 12C) automotive lift, was not installed with an automatic locking device (to function as an independent mechanical lock), nor were alternative safeguards (e.g. - properly rated and placed jack stands) used to ensure safe operation of this equipment. i) Service Shop, Bay #9 - The automatic locking device on the Globe (Model FSR-28) automotive lift would not independently hold an elevated vehicle (in the lift's maximum vertical position) as the lock was tested and found to be defective. Alternative safeguards (e.g. - properly rated and placed jack stands) were not used to ensure the safe operation of this equipment. j) Service Shop, Bay #10 - The Gilbarco (Model 12C) automotive lift was not installed with an automatic locking device (to function as an independent mechanical lock), nor were alternative safeguards (e.g. - Properly rated and placed jack stands) used to ensure safe operation of this equipment. k) Service Shop, Bay #11 - The automatic locking device on the Globe (Model FSR-28) automotive lift would not independently hold an elevated vehicle (in the lifts maximum vertical position) as the lock was tested and found to be defective. Alternative safeguards (e.g. - properly rated and placed jack stands) were not used to ensure the safe operation of this equipment. l) Service Shop, Bay #12 - The Gilbarco (Model 12C) automotive lift was not installed with an automotive locking device (to function as an independent mechanical lock), nor were alternative safeguards (e.g. - properly rated and placed jack stands) used to ensure safe operations of this equipment. m) Service Shop, Bay 13 - The Gilbarco (Model 12C) automotive lift was observed in use with an employee standing underneath a vehicle on the lift and adequate safety controls were not implemented. A lift automatic locking device was not installed to function as an independent mechanical lock, nor were alternative safeguards (e.g. properly rated and placed jack stands) in place to ensure safe operation of this equipment. n) Body Shop, Bay #14 - The automatic locking device on the Rotary (Model DTO 28 H) automotive lift would not have independently held an elevated vehicle (in the lift's maximum vertical position) as the lock was tested and found to be defective. Alternative safeguards (e.g. - properly rated and placed jack stands) were not used to ensure the safe operation of this equipment. o) Body Shop, Bay #17 - The automotive locking device on the Rotary (Model DTO 28 H) automotive lift would not have independently held an elevated vehicle (in the lift's maximum vertical position) as the lock was tested and found to be defective. Alternative safeguards (e.g. - properly rated and placed jack stands) were not used to ensure the safe operation of the equipment. ABATEMENT NOTE: Among other methods, one feasible and acceptable abatement method to correct this hazard is to comply with the most recent edition of the American National Standard, Safety Requirements for the construction, care and use of automotive lifts (ANSI B 1531). In the event a section is "grandfathered" by the ANSI Standard, then alternative safeguards which provide equivalent or greater employee safety needs to be implemented by the employer.ed
