Section 5(a)(1) of the Occupational Safety and Health Act of 1970: a) Warehouse/Shipping Dept.: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to an eighteen foot fall hazard. A Prime Mover hi-boy forklift is used to retrieve four(4) inch to one (1) inch pipe from a multi-tiered storage shelf located approximately six (6) to eighteen (18) feet above the floor level. Employee(s) operate the forklift without a safety belt.y

Employee(s) have to retrieve the pipe by stepping out onto an unsecured pallet which is used as a platform on the forks.rm
