Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to:
On and before June 24, 1994, the employer operated three stationary
compactors at the
Cedar Disposal, Inc. plant in Menomonee Falls, Wisconsin.  The compactors
were
operated to compress and push debris into removable compactor containers.
The
employer is a member of the National Solid Waste Management Association, a
mentor
organization responsible for the American National Standards Institute
(ANSI) Standard
Z245.2-l992, "Refuse Collection Processing and Disposal
Equipment-Stationary
Compactors-Safety Requirements".  The employer operated the compactors
without
having developed safe operating procedures in which he trained the workers
in,
monitored activity and enforced Section 6.1 of the ANSI Z245.2-1992
Standard which
describes in detail the employer's responsibilities for the operation of
stationary
compactors that includes:
The employer shall provide properly maintained stationary compactors that
meet
all applicable regulatory safety standards and shall be responsible for the
following:
a) Ensuring that the installation of stationary compactors conforms with
local codes, ordinances, and manufacturer's recommendations;
b) Providing for instruction and training in safe methods of work to
employees before assigning them to operate, clean, service, maintain, or
repair the equipment.  Such instruction and training shall include
procedures provided by the manufacturer.  The employer shall maintain
records as to the names of employees and dates of training;
c) Monitoring the employee's operation of stationary compactors and
taking appropriate action to ensure proper use of the equipment, including
adherence to safe practices;
d) Repairing, prior to placing the stationary compactor into service, any
mechanical malfunctions or breakdowns that affect the safe operations of
the equipment;
e) Establishing and following a program of periodic and regular
inspections of all stationary compactors to ensure that all parts,
component
equipment, and safeguards are in safe operating condition and adjusted in
accordance with the manufacturer's recommended procedures.  This shall
include keeping all malfunction reports and records of inspections and
maintenance work performed;
f) Protecting the operator at the point of operation, in the case
ofstationary compactors having a load height less than 42 inches, by one of
the following methods:
1) sustained manual pressure controls, with the control panel
located in such a way that the operator cannot reach the point of
operation, or;
2) the installation of a point-of-operation guard that shall:  prevent
entry into the point of operation, in itself, create no pinch point
between the guard and moving stationary compactor parts; offer
maximum visibility of the point of operation consistent with other
requirements; be interlocked in such a manner that the stationary
compactor cannot be operated if the point-of-operation guard is
removed; and be easily accessible for inspection and maintenance.
g) For stationary compactors fed by means of a loading pit that is flush
with the facility floor or end of a loading ramp, providing:
1) protection of employees by means of:
i) limiting access within 6 feet of the edge of the pit to
authorized employees;
ii) training authorized employees to recognize and avoid the
hazards associated with the pit area;
iii) requiring that others whose employees use the pit area
provide assurance of such training; and
iv) limiting access by unauthorized persons by installing
signs, such as RESTRICTED AREA - AUTHORIZED
EMPLOYEES ONLY
2) to the extent practicable that it does not interfere with the
operation of mechanized loading operations, toeboards to prevent
persons slipping into the pit; and
3) if trucks or other motor vehicles are unloaded directly into the
loading pit, a device to prevent such vehicles from rolling into the
pit;
h) Ensuring that stationary compactors equipped with automatic cycling
controls
are used only in locations where the charging chamber is not generally
accessible
while the compactor is cycling automatically.
i) Providing guard railings for dock ramps in accordance with ANSI
A12.1.These shall be located around the charging chamber opening if
walk-on ramps are
used to deposit refuse into the charging chamber.  Guard railings and
toeboards
shall be provided on the sides of walk-on ramps;
j) Utilizing the manufacturer's recommended procedures for the
lockout/tagout
of energy sources in a program complying with Part 1910.147 of Title 29 of
the
U. S. Code of Federal Regulations (OSHA).  The program shall include
provisions to ensure that all personnel are clear of the equipment prior to
reactivation;
m) Maintaining records or employee reports of malfunctions required in
6.2(c);
n) Specifically inspecting safety interlocks, switches, and other
protective devices
to ensure that these devices are not disabled or bypassed, and not to
permit the
stationary compactor to be operated unless these devices are fully
functional.
These inspections shall be in accordance with 6.1(e).
