Section 5(a)(1) of the Occupational Safety and Health Act of 1970: %% The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a)Precautionary measure specified in the manufacturer's operation manual, prohibiting riders on a JCB backhoe/loader, Serial # 14BT4107-33000-7, was not heeded, resulting in fatal injuries to an employee on August 2, 1995, at 800 Main Street, Pewaukee, WI. 53072. (b)Operating a backhoe/loader on wet, slippery, slope conditions is contrary to the warnings set forth in the equipment manufacturer's manual for safe operation. Among other methods, one feasible and acceptable means to correct these conditions is to assure that all backhoe/loader operators, study, understand and follow the danger, warning, and precautionary instructions as specified in the Manufacturers Manual and the Equipment Manufacturers Institute Safety Manual for operators.
