Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not furnish employment
and a place of employment which were free from recognized hazards that
were causing or likely to cause
death or serious physical harm to employees in that employees were exposed
to struck-by and/or caught-in
hazards:
a.In the lot, the employer did not ensure that the 1995 Chevrolet
Beauville shuttle van (VIN:
1GAGG35K3SF224474; license plate #:  AU35SG) was maintained and operated
in a safe condition,
thereby exposing the driver and employees to struck-by and/or caught-in
hazards.
Among other methods, feasible and acceptable abatement methods to correct
this hazard include, but
are not limited to, the following:
a.Repair the brake lights which were not working.
b.Repair the turn signals which did not work.
c.Install the missing interior door handle on the front driver's side door.
d.Reinstall the proper interior door handle on the front passenger's side
door.
e.Develop and implement a vehicle safety inspection log for drivers or the
responsible person to
use on a frequent basis.
f.Provide and document vehicle safety inspection training for the drivers
or responsible person.
g.Develop and implement vehicle safety and maintenance procedures.
h.Adopt and follow the State of Ohio laws for maintaining and operating a
vehicle in a safe
condition.
i.Follow the manufacturer's guidelines on maintenance and safe operation
of the vehicle.n
