Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not furnish employment and
a place of employment which were free from recognized hazards that were
causing or likely to cause death or
serious physical harm to employees in that employees were exposed to
struck-by and/or caught-in hazards:
a.In the yard, the employer did not ensure that the shuttle vans were
maintained and operated in a safe
manner, thereby exposing drivers and passengers to struck-by and/or
caught-in hazards.
Among other methods, feasible and acceptable abatement methods to correct
this hazard include, but are
not limited to, the following:
a.Require and enforce the use of seat belts for drivers of the shuttle
vans.
b.Require and enforce the use of the emergency brakes when the shuttle
vans are left running and
unattended.
c.To avoid confusion, require and enforce the rules of following the
posted traffic signs and
established traffic flow patterns in the yard.  On May 29, 2001, an
accident involving the 1999
Chevrolet shuttle van (VIN 1105974) and a new Honda Accord (VIN
1HGCG16511A071920)
occurred due to confusion relating to the posted signs and accepted work
practices.
d.On the 1995 Chevrolet shuttle van (VIN 194337), repair the emergency
brake and left blinker
which were not working.  On June 6, 2001, this vehicle was observed
running and unattended
while employees were at break.
e.On the 1995 Chevrolet shuttle van (VIN 171706), repair the reverse
lights which were not
working and the front right tire which was leaking air, and install a seat
belt approved by the
manufacturer.
f.On the 1999 Chevrolet shuttle van (VIN 1147525), replace the left rear
tire due to lack of tread.
g.On the 1998 Chevrolet shuttle van (VIN 1071840), repair the front side
markers which were not
working.
h.On the 1999 Chevrolet shuttle van (VIN 1146426), repair the rear brake
light which was not
working.
i.Implement a new policy on when to change tires on the shuttle vans.  As
required by the State of
Ohio, use the tread depth of one-sixteenth of an inch as a minimum
requirement for changing
tires.
j.Develop and implement a vehicle safety inspection log for drivers or the
person responsible for
safety to use on a frequent basis.
k.Develop and implement written vehicle safety and maintenance procedures.
l.Provide and document safe vehicle operation training to the drivers.
